New Laws Require New Updates

The new section of the website will contain both federal and state law discussions, as well as an examination of how homeowners can defend a foreclosure in court. This will be an indispensable resource both for borrowers and a guide for attorneys who are assisting in a defense and find a need to refer to the actual foreclosure laws.

A Simple Explanation of the Foreclosure Legal Process and Borrower Defenses

From the initial lawsuit to a potential deficiency judgment and bankruptcy, homeowners are always threatened with legal actions being taken against them during a foreclosure. But most borrowers attempt to qualify for a loan modification, sell the house, refinance with a foreclosure lender, or simply give up before they are required to move out. And this is all because they do not know how the legal process works to be able to defend themselves against a lawsuit.
Banks, on the other hand, may know little more about the legal process than than their foreclosure victims, but they have the means (ironically enough, paid for by the interest generated from other families' mortgage loans) to hire attorneys who have purchased computer software that allows them to make nice-looking legal forms and motions. Banks and foreclosure attorneys never expect to be challenged in court because so few homeowners know how to do it; even if they hire their own attorney, it is usually just to force a settlement.
Thus, a homeowner who understands three things about the legal system can fight a bank for as long as it takes. First, the borrower just needs to be aware of how the court works, what format motions should be put in, and other procedural rules. Second, homeowners need to have an awareness of some of the ways banks violate various rules, such as sheriff sale notification rules or the Truth in Lending Act. And finally, the owner has to be able to explain these violations in language the courts will understand and be able to put all of the burden of proof back on the bank and its attorneys.
A new section of the website may be created to index all of the new information that will be available here on this blog, including example letters or motions. With old and new defenses to foreclosure being discovered every day and being proven effectual against lenders' baseless lawsuits, homeowners can add utilize a number of new tools to save their home. We plan to detail at least two dozen ways that a mortgage company fails to prove its case or can be challenged in court.

We are planning some new updates to the website over the weekend, which will vastly increase the amount of information available to homeowners and others in the foreclosure industry. Check for new pages, better explanations, and updated information on the current pages.
Also... the big announcement: to all of our clients, we will be giving away a free foreclosure relief booklet. Because of the success of the original book, we have decided to give it away for free to everyone who submits their email to us, either through the info@foreclosurefish.com account, or by using the submission form on our site.
We hope everyone has a great weekend, and we look forward to adding more valuable content and services to all of our visitors.
Free Foreclosure Help -- More of it!

We are contemplating adding a FAQ for general questions, but the main argument against this type of project is very strong. Namely, every foreclosure situation is different and requires evaluation and consideration. There really are no simple, broad answers to stop foreclosure in general. Your situation is different from every other foreclosure victim and requires special attention.
The other main reason we do not wish to provide a FAQ is that it will take away valuable resources that can be directed to answering specific questions relating to foreclosure. As a case in point of the variety of foreclosure situations and our responses to questions, please see here.
However, we are planning on adding new information to our site in the near future. The goal of all of the information on our site is to help homeowners take responsibility for their mortgages and learn how to stop foreclosure without being taken advantage of by unscrupulous companies.
Thank you for taking the time to read our site and our blog, and we contine, as always, to look forward to helping all homeowners learn more about their mortgage, property, and the general economic conditions that contribute to situations that lead to foreclosure. We believe that even a small knowledge of all of these topics give homeowners the power to stop foreclosure successfully.

Foreclosure Scams Series - Change of Plans

Instead of a series of articles, we have decided to write a new, larger special report on general foreclosure scams, and the specific companies that commit these crimes.
This is, undoubtedly, a larger project than we originally anticipated it being, but we believe that a detailed analysis of specific foreclosure scams is well worth the time. It is important for homeowners to know, not only the general theories behind how foreclosure scams work, but how they have been committed over time. Scammers have changed and adapted their techniques to appear as legal as possible, exploiting loopholes in the system, or outright committing criminal acts regardless of the consequences.
Much of the research on some of these companies has been completed to date, and now needs to be organized and put together in a coherent manner. We plan on making the report available early in the new year, just in time for (hopefully) the end of foreclosure season in the U.S. housing market.

New Foreclosure Scam Series Being Planned

Our hope is that by being aware of specific ways that criminals scam their clients, our customers will be more successful in avoiding these scams and, ultimately, stop foreclosure.

Much of the information you need to save your home from foreclosure is freely available on the ForeclosureFish.com website. You are encouraged to read the foreclosure information on the site, and contact your lender directly to start the process of examining a repayment plan.
As a general note, remember to get everything that you discuss with your lender in writing. Verbal agreements or repayment plans mean nothing when you are trying to save your home from foreclosure.

Exciting Updates Being Implemented

We're glad to announce that some new and exciting changes are in the works for the ForeclosureFish.com website. We are optimizing the entire site for other browsers besides Internet Explorer, including the FireFox web browser.
Also, keep an eye on the "Foreclosure News" section of the site, as new stories will be updated on a continual basis to help all of our visitors save their homes from foreclosure.
The main focus of our site from Day 1 has bee to help people stop foreclosure and have as many options as possible. The new updates that will be should be completed by the end of the week.
